Terms of Service

These Terms of Service ("these Terms") set out the conditions for using the website ("this Site") operated by Kagawa Bonsai ("we," "us," or "our store"). By using this Site, you ("the User") agree to be bound by these Terms.

Article 1 (Application)

These Terms apply to all relationships between the User and our store regarding the use of this Site.

Article 2 (Account Registration)

Those wishing to register an account on this Site shall agree to these Terms and apply for registration by the method we specify.

• We may decline a registration application if the information provided is false, inaccurate, or incomplete; if the applicant has previously violated these Terms; or if we otherwise deem the registration inappropriate.
• Users are responsible for managing their own account ID and password. We bear no responsibility for any damage arising from inadequate management or unauthorized use by a third party.

Article 3 (Purchase of Products)

• Users may place an order for products by following the purchase procedure displayed on this Site.
• As many of our products are one-of-a-kind, some orders may not be fulfillable depending on stock availability.
• Due to fluctuations in stock availability, an item may already be sold out at the time of your order. In such cases, we may cancel the order, and the User agrees to this in advance.

Article 4 (Payment)

Payment methods and timing for products are as set out on the order completion page and in our Legal Notice (Specified Commercial Transactions Act).

Article 5 (Shipping)

We only ship within Japan. We do not offer international shipping.

Article 6 (Nature of the Products)

• The bonsai we sell are living plants, and each one is one of a kind. The photos on each product page are of the actual tree. We edit the background and color tones, but we never alter the shape of the tree. The shape and foliage may also differ slightly from the photos at the time of your order or delivery, due to the time elapsed since the photo was taken, growing conditions, seasonal change, and ongoing care.
• Colors may also appear slightly different from the actual product depending on your device and display settings.
• The condition of the plant after delivery (including, but not limited to, dieback, discoloration, or pest damage) results from the customer's own care environment and practices. Provided we shipped the item in good condition, we bear no responsibility for such changes after delivery.

Article 7 (Returns & Exchanges)

As bonsai are living plants, we generally do not accept returns or exchanges. However, in cases where damage occurs during shipping due to our responsibility, we will handle this on a case-by-case basis.

Article 8 (Taking Your Bonsai Abroad)

We ship only within Japan and do not offer international shipping. If you intend to take a bonsai you have purchased outside Japan yourself, you are solely responsible for checking and complying with the plant quarantine rules and other laws of both the exporting and importing countries. We are not involved in obtaining any export/import permits or quarantine procedures, and bear no responsibility for any resulting damage.

Article 9 (Intellectual Property)

The copyright, trademark rights, and other intellectual property rights in the text, images, photographs, logos, and other content on this Site belong to our store or to third parties with legitimate rights. Except as permitted by law, none of this content may be reproduced, repurposed, modified, or sold without our prior consent.

Article 10 (Prohibited Actions)

Users shall not engage in any of the following actions when using this Site:

• Acts that violate laws or public order and morals
• Acts that infringe on the rights of our store or third parties
• Acts that may interfere with the operation of this Site
• Use of this Site for fraudulent purposes

Article 11 (Suspension & Cancellation of Accounts)

• We may suspend a User's access to this Site or cancel their account registration without prior notice if the User violates these Terms, if their registration information is found to be false, or if we otherwise deem it inappropriate to continue their use of the Site.
• Users may cancel their account registration at any time by the method we specify.

Article 12 (Exclusion of Anti-Social Forces)

Users warrant that neither they nor their officers are, or have close ties with, organized crime groups, their members, affiliated companies, or other anti-social forces. If we determine that a User has violated this Article, we may terminate the usage agreement without prior notice.

Article 13 (Disclaimer & Limitation of Liability)

We bear no responsibility for any transactions, communications, or disputes arising between the User and other users or third parties in connection with this Site. Except in cases of our willful misconduct or gross negligence, our liability for damages to a User shall be limited to the purchase price of the product giving rise to the damage, and we bear no liability for indirect damages, special damages, or lost profits.

Article 14 (Changes to These Terms)

We may revise these Terms at our discretion without prior notice to Users.

Article 15 (Governing Law & Jurisdiction)

These Terms shall be governed by the laws of Japan. Any disputes arising in connection with this Site shall be subject to the exclusive jurisdiction of the court having jurisdiction over our store's registered location.
